Agreements, Signatures and Duty to the People. Will Steve Sisolak Cave?

Everyone in the RPN (Rural Preservation Neighborhood) area are appalled at the fact that after months and months of negotiations between the County, the City, and the People they represent, and after consensus and agreement being reached, that the Interlocal Agreement signed on Dec 21’st 2016, by Steve Sisolak will not be honored!

Of course as usual, a large developer has petitioned the BLM to put up a tract of land in the RPN for sale and has bid on it and is now trying to get the City to accept a General Plan Amendmend without any regard to the agrement that was reached with the people of the area and the County Government.

And of course instead of adhering to the agreed upon zoning and density they want to introduce a large scale build out right next to Rural Zoned Properties. Strangely enough the BLM chose not to sell them the area circled in Red! One has to wonder why?

So the real question is this. If the City Council meets and chooses to allow this in direct violation of the agreement that Steve Sisolak signed in good faith for the County and the People that reside in the RNP, will he instruct the County Attorney to sue the City to stop this and enforce the agreement, or will he cave under pressure from a large developer with $$$???

Sakes alive this is the person that is running for future Governor of the State! If his Signature, his word his promise is not good here, how can we expect it to be good anywhere! His ads make claims that he will help with School Classroom overcrowding. How in sam hill does allowing a developer to build out large densities without setting aside a place for Schools benefit the current Classrooms? The plain fact is it doesn’t and the Schools in this RPN area are already at over 125% capacity!

Don’t judge them by what they say, but by what they do. And if this goes the way I think it will, I’d rather hang my saddle on the fence and throw dirt at it than cast a vote for this person.

Sign, Sign, Everywhere a Sign

Well it’s probably a little to little and little to late, but it seems as if the people that live in the RPN finally drew a line in the sand and got some signs put out at boundaries of the RPN to let others know, yes they are moving into a Rural Preservation Area. This probably wasn’t easy to get accomplished and probably took some teeth pulling to get it done so hats off to those that put their time and effort into this! Be proud of your area and the way of life in it, or it will change rapidly!

And always remember,

Your fences need to be horse-high, pig-tight and bull-strong.

Officials MUST consider TRAFFIC!

Good day Neighbors. Musing over some interesting documents from the Nevada Supreme Court. It appears that our Officials be it County or City MUST consider traffic when making any kind of zoning decisions. Since I have heard from several “Officials”
that increased traffic doesn’t matter in their decision, they are simply wrong and we need to change their attitude.

641. State v. Coleman, 67 Nev. 636, 224 P.2d 309 (1950) :

“The court recognizes the fact that the matter of zoning has received the attention of commissions and experts whose reports bear every evidence of painstaking consideration, and that they concur in the view that the segregation of residential, business and industrial buildings ‘will increase the safety and security of home life, greatly tend to prevent street accidents, especially to children, by reducing the traffic and resulting confusion in residential sections, decrease noise and other conditions which produce or intensify nervous disorders, preserve a more favorable environment in which to rear children, etc.'”

Well I’ll be, “nervous disorders” alright, all that traffic in our rural area is VERY upsetting to people who like to live rural and it will eventually drive some people out of the area (which would make the big developers very happy I’m sure).

Most of these builders fail to provide any evidence that a hardship or difficulty that exists which warrant the granting of these zone changes other than lining their deep pockets! They can just as well use the property in the way it was originally zoned. This is a really good case.

Enterprise Citizens v. Clark Co. Comm’rs, 112 Nev.Adv.Op. 86, 918 P.2d 305 (1996).

This is why it’s important for the neighbors to dig up any evidence or prior cases
and/or provide cases like this and get them on the record whenever they try to do a zoning change against our rural area. Then the Commissioners and or Councilman have no excuse to deny the change, a lot of times they are worried about the big builders causing them trouble in future elections etc, but if there is enough evidence and objection they can feel better about their decision. Some of the evidence mentioned in cases are letters of protest, testimony of homeowners, commissioner’s statements, town
board recommendations of denial based on traffic and neighborhood protests, and recognition that schools in area well over capacity!

Thanking everyone in advance for their perseverance, as more rural folks leave the area it’s important for those of us left to keep fighting the good fight.

The Screaming Lady at 5AM!

A neighbor recently wrote:

When the police come to your home before 6AM because your new neighbors (thanks DR Horton) hear a girl screaming for help in your backyard. Heeelllllppp! Heeeeellllllppp! Only she wasn’t screaming for help, just breakfast and she’s a goat! Oh my Lordy! Scared the tar out of me thinking it was a kid that slept walked and got locked out. Or worse maybe an actual lady in my backyard. I was so asleep, it took me a min. My husband feeds before he leaves for work about 5:30. At first I thought they were going to come tell me something bad about my husband being in an accident. In my head I’m taking role call. Nope…….none of that, just a hungry goat. Welcome to the RNP neighbor! Hehe oh and she’ll do it tomorrow, and the next day and the next day and the day after that! The police officers were busting a gut and one was like frikkin goats. It’s the goats every time! Haha they were laughing so hard. I told them to stay safe and glad this call was a good one!

Well that’s the first but it won’t be the last. Apparently these new neighbors have no clue where they are living. Apparently the developer D.R. Horton either provided them with the disclosure they were supposed to in the smallest print possible, or they did not inform them at all. How many times will the Police be called before someone gets hurt, or they just start ignoring the area. My question is, what are they going to do when the dust settles!

Special Use is on the Loose!

Slowly they wrench and gnash their teeth,  but surely into more parts of the Northwest RNP Neighborhoods. Other than the occasional Barn you see going up from time to time, is it even recognizable anymore as a Rural Area? Sure enough when a developer can’t get zoning changed easily, the tool of choice is the Special Use Permit. These are for well, Special Uses, like Churches, or Elderly Care Centers etc.. The RNP just took another hit today when an Assisted Living Facility, that was poorly designed, poorly planned and offering slave wages of $ 11.68 / Hour to Skilled Nurses is moving in thanks to the reversal of the County Commission.

Even though the Planning Commission turned this down probably due to piss poor planning, the Commission passes it unanimously. With certain conditions of course. Conditions that can hardly be enforced because usually when they are broken the County is off duty!

Another piece of the Rural Preservation Area is gone with the wind…

Greed and Politics have ruined RNP.

There is a remarkable amount of video information by user Sincitysound on youtube. Please watch, it’s amazing how other RNP’s in the Las Vegas Valley have been literally destroyed with SPOT ZONING. An interesting fact presented in these video’s is that in most areas across the United States, the zoning master plan is changed every 20 YEARS! In Clark County it’s every 5 YEARS with ammendments every year!! How can people plan their future lives and neighborhoods in this fashion!

Keeping an eye out for Developers and Councilman Ross!

Here we go again folks, there is never a time to relax! Here we have a developer who has annexed his land into the City of Las Vegas and is requesting them to ammend their general plan and rezone the land from RE to R1 high density housing! This is in the RNP area and is next to homes all around it that are 1 per 1/2 acre! What happened to the City’s Promise about keeping land zoning the same. Will they keep their word? Will my zoning change?

The annexation will bring each property in with a city equivalent zoning and any current land use entitlements will also be accepted by the city. This includes accessory structures (sheds, garages, casitas, etc.) and current setbacks of structures.

They have always promised to keep the zoning the same but the attacks never cease.

UPDATE: On Feb 1st, 2016 at the City of Las Vegas Recommending Committee meeting, this property was up for annexation at the request of the owner. A neighbor attended this meeting intent on trying to find out if the zoning would change. Here is the link to the agenda item.

Welcome to Monsoon!

Most stared in disbelief as a boxspring and mattress rushed by in the deluge of water that was dumped onto the NW RNP area this weekend.

All I can say to all the new homeowners in their HOA’s is welcome to Monsoon! It vary’s from year to year but I have a hinckering that this year is going to be a bad one. If the record breaking heatwave is any indication of what’s to come when the monsoonal flows from the Gulf start pumping moisture up and into the valley, watch out! Rural Street Study for RNP your input requested!

The county is requesting all RNP neighbors to please submit their input in a study to set a standard for future streets in the RNP Area. Sandy Lopez has a good article about this in the Northwest View Here.

It is important to set these standards but most important is to set standards for the builders like D.R. Horton so they know that we don’t want or need their stinking gated community concept in a rural area and we will fight tooth and nail to keep them out.
